Your Best Choice
A trademark for the words "Your Best Choice" was not, in fact, the company's best choice.
On June 9th, 2025, the Trademark Trial and Appeals Board (TTAB) upheld a ruling denying the School Board of Palm Beach County a trademark for the words "Your Best Choice."
The refusal was based on "Failure to Function." The purpose of a trademark is to help consumers identify the source of a good. A failure to function refusal is given when a slogan, brand name, or logo is so widespread, that it cannot be said to clearly identify a single company.
The examiner then pointed out 44 other companies that declared themselves to be "your best choice." Clearly, the words "your best choice" are a common expression, and therefore not identifiable with any particular company.
So at this point, why not jump on the bandwagon? I will throw my hat in the ring, and say that Lindner Legal is "your best choice" for a trademark law firm. Now the examiner can make it 45 other companies.
